Terms of Service

Terms of Service: CenterStage Performing Arts Academy
Welcome to CenterStage Performing Arts Academy! These Terms of Service ("Terms") govern your use of our website, services, and products provided by CenterStage Performing Arts Academy. By accessing or using our website, services, or products, you agree to be bound by these Terms. Please read them carefully before using our services.
  1. Use of Services:
    • You must be at least 18 years old to use our services. If you are under 18, you may only use our services with the involvement of a parent or guardian.
    • You agree to use our services only for lawful purposes and in compliance with all applicable laws and regulations.
  2. User Accounts:
    • In order to access certain features of our services, you will be required to create a user account.
    • You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.
    • You agree to provide accurate, current, and complete information when creating your account and to update your information as necessary to keep it accurate and complete.
  3. Intellectual Property:
    • All content included on our website, such as text, graphics, logos, images, audio clips, video clips, and software, is the property of CenterStage Performing Arts Academy or its licensors and is protected by copyright, trademark, and other laws.
    • You may not reproduce, distribute, modify, or create derivative works of any content on our website without the express written consent of CenterStage Performing Arts Academy.
  4. User Conduct:
    • You agree not to:
      • Use our services in any way that could damage, disable, overburden, or impair our servers or networks.
      • Attempt to gain unauthorized access to any part of our services or to any user accounts.
      • Use our services to transmit any viruses, worms, or other malicious software.
      • Engage in any conduct that is unlawful, offensive, or harmful to others.
  5. Payment:
    • Payment for our services must be made in accordance with the pricing and payment terms provided on our website.
    • All payments are non-refundable unless otherwise stated in writing by CenterStage Performing Arts Academy.
  6. Limitation of Liability:
    • To the fullest extent permitted by law, CenterStage Performing Arts Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use our services; (b) any conduct or content of any third party on our services; or (c) unauthorized access, use, or alteration of your transmissions or content.
  7. Termination:
    • We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
    • Upon termination, your right to use our services will immediately cease.
  8. Changes to Terms:
    • We reserve the right to update or change these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our website.
    • Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
  9. Governing Law:
    • These Terms shall be governed by and construed in accordance with the laws of Tennessee, without regard to its conflict of law provisions.

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

Waivers and Policies

Classroom and Waitlist:
I have read and understand what items are required for my student's dance class, per the Dancewear page on the website. I understand that failure to comply with the dress code means my student may sit and observe class instead of participating. This includes the policy on midriffs and crop tops. 

I understand that parents are not allowed backstage or in the classroom unless given permission by a CenterStage staff member. This can be very disruptive to the class, instructor, and other students participating. 

I understand that while my student is at CenterStage, all students are required to register as, use the restroom, dressing rooms, and dress in the class attire/costumes of their sex assigned at birth. There is a zero tolerance policy if a student chooses to use the restroom not of their sex assigned at birth and they will be dismissed from CenterStage.

I understand CenterStage has a max number of students it can accept per class time based on the type of class, age of the students, and size of the room. It is also very important that each student receive equal attention and corrections from their instructors, thus we keep class sizes small. If your student is added to a waitlist and a spot opens up, students will be added in the order of which they waitlisted. Similarly, a SpringBoard productions' max capacity is set by each directing team and how they plan to stage and block their show. SpringBoard variety shows have more flexibility as they are written around the student than summer musicals that are licensed through a company. If your student is added to a waitlist and a spot opens up, students will be added in the order of which they waitlisted.

I understand that CenterStage primarily works with students ages 2 - 18. Once a student graduates from high school, they may continue on with CenterStage in private lessons or Adult classes. They may not rejoin regular dance classes after graduating.

Recital:
I am aware that CenterStage hosts 12+ recital in the month of May. I understand that when I sign up my student up for more than one class, or several of my students up for classes, that this will most likely mean that my student will be performing in more than one recital. I understand that it is my responsibility to communicate immediately with CenterStage if my student can attend one performance and not another. It is my responsibility to purchase tickets for whichever recitals I choose to come to and to have read all recital information for each recital my student is in.

I understand that in order for CenterStage to produce a recital, CenterStage must charge admission to cover the cost of staffing, security, printing, etc... fortunately, CenterStage is in a position where it does not have to also charge a recital fee in addition to admission to cover the cost of the space since all recitals are in house.
I understand that if I do not purchase tickets when they go on sale that there is a high likelihood that the recital may be sold out. In the event this happens, CenterStage cannot guarantee seating will be available but will try work to offer at least one ticket (if the theatre can accommodate the extra seating) per student. 

I understand that directors and instructors may make an exception for a new student transferring into an existing class. In these cases, the new student will be prepared to join the class in technique and application knowledge. 

I understand that should I choose not to participate in recital that I must communicate this by April 1st or be subjected to a fine of $100 per class. Emergencies or injuries that happen after this date will not be subject to the fee. *Recital dances are finished before Spring Break. When a student is unable to perform, this changes the choreography and blocking, adding additional rehearsal time for instructors and students. This fee helps to cover that additional practice time to ensure the class is ready for recital.

I understand that if my student has an injury between April and June that could allow them to still participate in recital with a brace, cast, or altering of some choreography, it is at the instructor’s discretion if they feel their class can work around this. If an instructor does not feel that this injury can be worked around, the student will not participate in recital but will not be fined.

Attendance, especially during recital season is crucial to produce an excellent final product - the recital dance. Students who miss class with no communication or ignore requests for private lessons with the instructor or extra practices may be removed from the recital number at the instructor’s discretion. This is to protect the time of those who have been in class and are prepared to perform.

I understand that attendance at CenterStage's tech rehearsal is very important. Failure to attend may result in my student being unable to participate in recital. 

I understand that the Private Lesson recital is a performance opportunity for students enrolled in a private lesson only.

Attendance:
I agree to let CenterStage instructors and office management know if my student will be absent or have to leave early, as this is disruptive to class. I understand it is not acceptable for an absence to be communicated in person to an instructor or for other classmates to communicate this absence.

Should my student need to leave early, I understand that only CenterStage staff may go into the classroom to collect my student.

I understand and agree that if a scheduling conflict arises that involves my student missing more than 25% of class time each week, the office management will discuss a plan for private lessons or un-enrollment at this time.

I understand that CenterStage wishes to protect all students, instructors, and their class time. I understand that for all classes my student may not miss more than 8 classes a year unless it is related to a grade at school. A student who misses more than 8 classes and does not come in prepared and caught up on choreography may warrant removal from certain sections of the dance, blocked into a new position, or a discussion to remove the student from that class if they cannot keep up with their cohort. Choreography and skills are important to our studio and multiple absences affects the growth and performance of the entire cohort.

I understand that if my student makes their Middle School or High School Dance Team, Choir, or Theatre program at school, that it is my responsibility to communicate all absences to CenterStage immediately. I understand that if my student is placed in a leveled class, which is treated like a competition/company class, that CenterStage may feel it best to move my student to a different class that may accommodate their schedule better. I will respect CenterStage’s decision in this.

I understand that if my student misses multiple classes during the month of recital, my student may be not be allowed to perform and the $100 charge per class assessed to my account.


I understand that if my student misses the technical or dress rehearsal without communication, they will not be allowed to perform in recital, and my tickets will not be refunded.

I understand during the year that if my student misses more than 3 classes of a specific style in a semester, their instructor may require private lesson(s) to make sure they are caught up in their class and ready for performance. I agree to pay for these additional private lessons.

The cut off for private lessons to prepare a student for recital is May 1st. If a student has missed more than 3 classes and has requested a private lesson after May 1st, participation in recital is at the discretion of the instructor.

I understand that students who begin to Zoom in often to class may still be required to take private lessons in order to catch up with their class.

I understand if my student misses 25 or more of their classes in a year, CenterStage can choose to not allow a student to participate - regardless of whether the student ordered a costume or not.

I understand that in order to receive a make up lesson or credit for a lesson, I must give the instructor a 24 hours notice.

Costumes:
Costumes are required for each routine a student will be performing in the year-end recital. Prices range from $50 to $125 per costume and include tights.

Costumes must be paid in full by November 3rd, 2023.

Costumes not paid in full by November 3rd, 2023 will not be ordered and students will not be able to participate in recital. No exceptions.

I understand that if I withdraw after November 3rd, 2022 my costume has already been ordered, and I will receive it when it comes in - no refunds.

The costume must be picked up before July 1st, 2024, or it will be donated.

I understand and agree to let CenterStage handle all costume exchanges and alterations. CenterStage shall communicate directly with the in-house seamstress and is the final decision on the fit of a costume.

Students are measured for costumes in September of 2023, if a parent is concerned about the right size being ordered, they should speak to Brendan Tramel before October 1st.

Payment Information:
I understand that tuition is paid in nine installments that are due on the 20th of each month from August - May.
Holidays and closures are already calculated in your nine payments.

I understand the following payment policies and will adhere to them. Theater program deposits are due upon registration. Dance & music program tuition is due by the 20th of the prior month (September tuition is due by August 20th, and so on).

All fees may be paid by cash, check, or card.

Tuition is considered late by the 21st, and all accounts will be charged a $10.00 late fee.

If an account is not paid by the 25th, the fees (including the late fee and any other balance) will automatically go to auto draft - NO exceptions.

Everyone MUST keep a card on file.

Any bounced checks or accounts are subject to a $25.00 fee.

​I understand that CenterStage may require payments made in cash if my payments have been late, or my account has been overdrawn.

I understand that should I fall a month behind in tuition my student will not be allowed to participate in class until the account is paid in full. This includes all late fees.


I understand that should I fall 6 weeks behind in tuition, my student will automatically be dropped from classes. If I choose to re-enroll, I will be responsible for another registration fee.


I understand SpringBoard and Summer Musical deposits are non - refundable.


I understand that SpringBoard and Summer Musical tuition is non - refundable once the show is cast.


I understand monthly tuition covers my instructor's time and the upkeep of the building.


I understand that CenterStage charges admission to its shows to fund the cost of mounting the production - which is different than instruction time.


Email:

I understand that email is the main method of communication at CenterStage, and confirm that I have provided an accurate email address. I understand that I am responsible for checking my email for all important information and announcements, and for ensuring that CenterStage emails are not being filtered to a spam/junk folder.

Withdrawal:
I understand that I must submit an official withdrawal in person or via email to withdraw a student from any and all CenterStage activities, with no less than a two-week notice. I understand that I will still be required to pay for any classes that occur before the final withdrawal date, regardless of attendance.

Waiver and Release of Liability:
As the legal parent or guardian, I do hereby give permission for my daughter/son/ward to attend and participate in all events sponsored by CenterStage Performing Arts Academy. I hereby acknowledge that by attending and participating in such events that there is a possibility of physical illness or serious/fatal injury to my daughter/son/ward and I do hereby for myself and others who might have a similar claim waive, release, hold harmless and forever discharge any rights and claims for injury, which may arise now or in the future against CenterStage Performing Arts Academy, its owners, operators, officers, agents or representatives for any and all damages which my daughter/son/ward may sustain or suffer while attending and participating in the events (classes/performances).

Behavior and Creative Freedom:
CenterStage will address all student behavioral issues in a polite and professional manner. I understand that in the event that a concern or issue arises I will only email [email protected]. I will not text or discuss the concern with an instructor or other member of staff. 

I understand that if instructors or staff witness a student or parent speaking ill of another student, dance parent, or member of staff, they may ask them to leave class or the building. 


I understand that CenterStage has the right to refuse enrollment or involvement of any family or student who slanders, verbally intimidates, or threatens a CenterStage instructor or staff person for any reason. 


CenterStage has a zero-tolerance policy on accusations that question the integrity of an instructor or the business. 


CenterStage has a zero-tolerance policy for physical or verbal acts of aggression against a CenterStage instructor, staff person, or another CS student. 


I understand that disrespectful comments or blatant disrespect in the classroom to an instructor or classmate will not be tolerated. A student will receive one verbal warning before being dismissed.


I understand that many of CenterStage students may socialize outside of CenterStage. CenterStage can only be involved and work towards a solution when the student interactions happen physically in class or at a CenterStage event. 


I understand that in the event that there is a student relationship or friendship that ends during the dance season, it is not CenterStage’s responsibility to mitigate the gossip or emotions surrounding this decision. Students are expected to act civilly towards each other in class and while in the CenterStage common areas (lobby, kitchen/student lounge, bathrooms, and parking lot). If gossip and behavior start to affect the class morale, CenterStage will not take sides but will dismiss all parties involved from the studio. All parties will receive one verbal warning from their instructor and one final warning from a CS Owner, before being dismissed.

CenterStage chooses to take a more conservative approach when it comes to costuming, music selection, choreography, and creating a show. We understand that in some cases, our choices may not align with some of our families. We ask, if this is the case, that our families make the best decisions for their student, and not expect our instructors and other students to make these changes. 

As the parent, it's my responsibility to understand the difference in techniques and choreographic styles of each genre I enroll my student in. It is not the responsibility of the instructor to adjust technique or choreography for a parent - any such change must come from the director. 

I understand that opinions on choreography or other dancers should not be shared amongst other families or students. Voicing these thoughts openly is damaging to our CS Family and can negatively impact performances.

Info Page:
I have read the Info page on the website and I agree to abide by the rules and guidelines within it regarding: tuition payment schedule, declined cards, bounced checked, missing class, cancellation policy, newsletter and email communication, weather related closing, parking, and waiting/lobby area.

Communication:
I understand the operating and work hours of CenterStage. If an email or phone call is sent on Friday after 12:00 PM it will not be returned until the following business day. 

I understand that in certain situations I may have access to a staff member's personal cell phone number. Unless it is an emergency, I agree to respect their personal time and to only contact them between the hours of 8:00 AM and 7:00 PM, Monday through Thursday if the conversation is regarding the business of CenterStage. 


I understand that it is CenterStage’s policy to not allow in-person or over-the-phone meetings about sensitive topics between an instructor and a parent unless Brendan Tramel or Natalie Hudson are present. Any request for a meeting must be approved by Natalie Hudson as all staff are paid for their time to meet with a parent. Email discussion of questions and concerns is our usual practice. In a situation where a meeting is deemed necessary, the parent must provide the details of the concern and a time limit will be set to respect the staff’s time.

I understand that the Office Manager (Brendan Tramel) has jurisdiction over the lobby and kitchen/student lounge. I understand that it is part of her job to keep students and their dance items safe. 

I understand that all conversation with the office manager or in the lobby should be polite,  professional, respectful of CenterStage and what the studio, staff, and instructors are working to accomplish, and involve topics that students would be allowed to overhear. Any deviation from this will be addressed with the owners and those families may be contacted.

I understand that the format or way I spell my child’s name in the Parent Portal is what we will be printed on all programs and certificates. I have double checked the spelling and formatting and it is consistent with what I would like printed.

I understand that CenterStage is a business and may refuse business if they so choose. CenterStage works very hard to manage all aspects of our students’ performance education, often times requiring staff to work over time to accomplish this. We are usually happy to do this. However, if going above and beyond is not appreciated by the family and student and is reflected in poor or mean communication and attitude, CenterStage will not allow that family to re-enroll the following season. We are very protective of the culture we have built and if it’s not working out will remove families who do not support our culture.

Medical Treatment Authority and Safety Policy:
The undersigned gives permission to CenterStage Performing Arts Academy, its owners, operators, officers, agents or representatives to seek medical treatment for the participant in the event they are not able to reach a parent or guardian. I hereby declare any physical/mental problems, restrictions, or condition and/or declare the participant to be in good physical and mental health. I hereby authorize CenterStage Performing Arts Academy, its owners, operations, officers, agents or representatives (staff members) to obtain or administer medical treatment for my daughter/son/ward for such injury or illness during any event (class/performance), and hereby hold CenterStage Performing Arts Academy, its owners, officers, agents or representatives harmless in the exercise of this authority. I assume full financial responsibility for such treatment. I understand that it is my responsibility to make sure my child enters and exits the studio safely.

Permission for use of Photograph and Security Surveillance:
As the legal parent or guardian, I grant permission to CenterStage Performing Arts Academy to use my daughter/son/ward's picture in future advertisement and literature (including website) solely for the benefit of CenterStage Performing Arts Academy and events sponsored and conducted by them. By signing this document, acknowledge that I am the legal parent or guardian of the child being enrolled with CenterStage. I acknowledge that CenterStage Performing Arts Academy may engage the use of audio/video recording devices on the premises of CenterStage for security purposes. I therefore release the following rights of myself, my child or ward: the right of my myself or my child or ward's image, likeness, and voice as recorded on audio or video surveillance. Additionally, I waive these rights without payment or any consideration. I understand acknowledge that myself or my child or ward's image may be edited, copied, exhibited, or distributed for security purposes. I waive my right, and the right of my child or ward, to inspect or approve of any security surveillance video.

I understand that security surveillance footage is at the discretion of CenterStage to view and pull should CenterStage feel there is a concern.

I understand that if my student is signed up for a Wednesday morning class, that their photo time during CenterStage’s Photo Week will be on Monday at 4:00pm to accommodate the photographer’s day job.

Levels, Placement, and Assessment:


I understand each student is closely evaluated by the faculty and director, and that they are a professional in this field. CenterStage has a syllabus for each class that the faculty follows. Once the dancers progress beyond the combo classes, students do not move up to the next level according to age or the amount of years that they have studied dance. Levels at CenterStage are designed to be repeated for multiple years. They must be able to execute proper technique of movement at that level consistently. It is extremely important that dancers are placed in a level that is appropriate for them, as frustration and even injury may occur.

CenterStage faculty spend a considerable amount of time placing students in the correct classes for the following season. Instructors take into consideration mastery of skills, performance, preparation and focus in class, how a student has acted in class during the current season, and maturity when placing students. Students usually remain in the same level for a few years before being completely ready to move up. If a student is repeating a level, they are not necessarily repeating skills. They may be in the same number level but their curriculum will be adjusted for the new season so they are learning new skills.

If a student would like to work for an opportunity to move up a level, they should reach out to [email protected] and discuss taking private lessons throughout the summer. In August, they would be assessed to see if they have mastered the skills needed to move up.

Assessments are reserved for new students transferring in from another dance studio or for a student who has taken a genre in the past and is wanting to get back into that field of study - not for a student/family who feel their student placement is incorrect.

​Registration Fee:

I understand that by enrolling in any class and/or offering at CenterStage (excluding summer season programs), a $55 registration fee is due upon completion of this form and will automatically be charged to the credit card I have provided. This applies to students who are new to CenterStage or at the start of a new year (starting in September). This registration fee is not refundable under any circumstances.
